Talaq or Khula: Which Applies to You?

The right legal route depends on who is seeking the divorce and the circumstances of the marriage. We help you choose correctly from the start, saving time, cost and stress.

Talaq: the Husband’s Right

A husband pronounces Talaq and must send written notice to the Union Council. After a 90-day reconciliation period, the divorce becomes effective and a certificate is issued.

Khula: the Wife’s Right

A wife files for Khula in the Family Court. On dissolution she may return or forgo her Haq Mehr. The court decree is then sent to the Union Council for registration.

A verbal or written Talaq alone is not legally complete. Divorce becomes legally recognised only after the notice is served on the Union Council, the 90-day reconciliation period passes, and a divorce effectiveness / NADRA divorce certificate is issued. This certificate is the final, provable evidence of divorce in Pakistan and abroad.

For Talaq, the law requires a mandatory 90-day (roughly three months) reconciliation period from the date the Union Council receives notice, after which the certificate is issued. Khula through the Family Court can vary but is often resolved within a few months. We work to complete every step without avoidable delay.
