Divorce in Pakistan, Your Questions Answered

No. A verbal or written Talaq is not legally complete on its own. The divorce must be notified to the Union Council, the 90-day reconciliation period must pass, and a divorce effectiveness / NADRA certificate must be issued. Only then is the divorce legally final and provable.

Talaq is the divorce pronounced by the husband and processed through the Union Council. Khula is sought by the wife through the Family Court, where she may return or forgo her Haq Mehr. Both end the marriage once registered.

A Talaq requires a mandatory 90-day period after the Union Council receives notice. A Khula through the Family Court varies but is often completed within a few months. We work to avoid unnecessary delay.

For Talaq, the husband does not need the wife’s consent. For Khula, the wife does not need the husband’s consent, the court can grant it even if he objects.
